Acceptable
Use Policy
The purpose of this Acceptable Use Policy is
to enhance the quality of the Services and to
protect SSSINC Hosting Solutions (sssinc-hosting.com)
customers, and the Internet community as a whole,
from illegal, irresponsible, or disruptive Internet
activities. This Policy applies to each Customer
and its employees, agents, contractors or other
users of such Customer who obtain Services from
sssinc-hosting.com. Each User should use common
sense and good judgment in connection with the
Services.
I)
Prohibited Uses
A. Utilize the Services to send mass unsolicited
e-mail to third parties.
B. Utilize the Services in connection with any
illegal activity. Without limiting the general
application of this rule, Users may not:
(i) Utilize the Services to copy material from
third parties (including text, graphics, music,
videos or other copyrightable material) without
proper authorization.
(ii) Utilize the Services to misappropriate
or infringe the patents, copyrights, trademarks
or other intellectual property rights of any
third party.
(iii) Utilize the Services to traffic in illegal
drugs, illegal gambling, obscene materials or
other any products or services that are prohibited
under applicable law.
C. Utilize the Services in connection with any
tortuous or actionable activity. Without limiting
the general application of this rule, Users
may not:
(i) Utilize the Services to publish or disseminate
information that (A) constitutes slander, libel
or defamation, (B) publicizes the personal information
or likeness of a person without that persons
consent or (C) otherwise violates the privacy
rights of any person.
(ii) Utilize the Services to threaten persons
with bodily harm, to make harassing or abusive
statements or messages, or to solicit the performance
of acts or services that are illegal under applicable
law.
D. Utilize the Services in connection with any
other disruptive or abusive activity. Without
limiting the general application of this rule,
Users may not:
(i) Utilize the Services to cause denial of
service attacks against sssinc-hosting.com or
other network hosts or Internet users or to
otherwise degrade or impair the operation of
sssinc-hosting.com servers and facilities or
the servers and facilities of other network
hosts or Internet users.
(ii) Utilize the Services to subvert, or assist
others in subverting, the security or integrity
of any sssinc-hosting.com systems, facilities
or equipment.
(iii) Utilize the Services to gain unauthorized
access to the computer networks of sssinc-hosting.com
or any other person.
(iv)
Utilize the Services to provide passwords or
access codes to persons not authorized to receive
such materials by the operator of the system
requiring the password or access code.
(v) Utilize the Services to (A) forge the signature
or other identifying mark or code of any other
person, (B) impersonate or assume the identity
or any other person, or (C) engage in any other
activity (including "spoofing") to
attempt to deceive or mislead other persons
regarding the true identity of the User (excluding
the use of anonymous remailer or Internet nicknames).
(vi) Utilize the Services to distribute or post
any virus, worm, Trojan horse, or computer code
intended to disrupt services, destroy data,
destroy or damage equipment, or disrupt the
operation of the Services.
(vii) Utilize the Services to conduct port scans
or other invasive procedures against any server
(except any server for which the User is an
authorized system administrator).
(viii) Utilize the Services to distribute, advertise
or promote software or services that have the
primary purpose of encouraging or facilitating
unsolicited commercial e-mail or spam.
(ix) Utilize the Services to solicit or collect,
or distribute, advertise or promote, e-mail
address lists for the purpose of encouraging
or facilitating unsolicited commercial e-mail
or spam.
(x) Utilize the Services in any other manner
to interrupt or interfere with the Internet
usage of other persons.
(xi) Utilize the Services in conjunction with
file/media hosting, no shared/reseller/shell
plans permit this, Dedicated servers are essentially
unmanaged thus permitting it.
(xii) Abusive bandwidth use, as the plans all
state bandwidth for ircds and shells is unmetered
NOT unlimited, please do not abuse the privilege.
(xiii) Abusive CPU use, this shall include but
not be limited to the running of Eggdrop botpacks,
if you absolutely must make use of a botpack
you are REQUIRED to get permission to do so
from the SSSINC owner in advance otherwise your
account may be suspended.
(xiiii) psyBNC processes on shared hosting (shell
accounts) are limited a maximum of 2 irc connections
(max 1 BNC Process per account/login).
Eggdrop processes are allowed a maximum of 1
irc connection. Accounts in violation are subject
to one warning and suspension if the client
is not cooperative in rectifying the violation.
(xv) Web Reseller Plans are NOT permitted to
provide "free" hosting accounts (screened
accounts where user has been voice verified can
be permissible provided no AUP violations
occur). As free accounts tend to cause issues
with services we can not permit them.
sssinc-hosting.com and it's affiliates reserve
the right to deal with any violations of this
policy as we see fit: Common results may include
but are not limited to:
1. Charge of any additional compensation fee
(Depending on what type of violation)
2. Suspension of the Account in question
3. Termination of the Account in question [with
or without refund at our (SSSINC's) discretion]
4. Any further actions permissible by law (depending
on the extent of any damage caused and how many
offenses had occurred)
5. Spam Related Policy:
"Spam is unsolicited bulk email, whether
commercial or non-commercial. Bulk email is two
or more essentially identical copies of the same
message, sent to multiple recipients. Spam will
incur immediate account suspension and
investigation, followed upon verification by
cancellation of the account with no refunds.
Spam in the amount of two or more individual
emailed copies of the same message, regardless
of the number of actual recipients, will incur a
fee of $100, per incident. This definition of
spam does not apply to accidental programming
errors, provided it is reasonably clear that
there was no obvious intent to spam, and
provided every reasonable effort was made by the
Customer to immediately forestall further
accidental incidents, and provided the Host is
immediately notified of the incident. Egregious
activities, such as the use of special scripts
intended to evade detection, will incur an extra
fee of $400 per calendar day of such activity,
plus such fees as must be levied to recover
costs to the Host imposed upon the Host by the
data center as a direct or indirect result of
said egregious activities."
Terms
Of Service
1. All sales final, refunds may be given but
are not guaranteed.
2. All services are billed on a monthly basis
client may cancel with one weeks notice, in
which case hosting will end when client cycle
begins for the next period.
3. Customer agrees by signing up for SSSINC
Hosting Services any invoice payments shall be
remitted by the due date of their invoice and no
later. Customer also agrees to any suspension or
further action should they choose to remit
payment after their due date (this will include
but not be limited to account suspension).
4. We at SSSINC do pride ourselves on a speedy
technical support system. All tickets are answered
normally within 15 minutes or less, however
we do ask for up to 18 hours be given for responses
as times do vary during the week.
5. There is no setup fee for services provided
as we do not do managed hosting services unless
done via a custom quote please contact sales@sssinc-hosting.com
if you desire a managed service such as managed
ircd hosting or anything along those lines.
6. Any payments made must include some form
of verification (i.e. Money Order w/ Driver's
License), PayPal payments must include your
confirmed address, verified or not it is required.
If the requirements are not met you will either
be refunded or account setup delayed until the
account can be verified.
7. We reserve the right to refuse services to
any customer for any reason deemed applicable,
however we will attempt to accommodate any clients
with special installs if they are required by
software provided the installs would not conflict
with current software, cause any security holes
in the system, or create instability of the
server.
8. Resellers:
a.) Resellers of SSSINC submit that upon order
of services SSSINC Hosting Solutions as well as
any and all of it's affiliates and
sub-organizations are not to be held liable for
the reseller's dealings, this shall include but
not be limited to the reseller's clients.
b.) Reseller further agrees that they will be
held responsible for any and all clients they
provide services to which are hosted from SSSINC
Hosting Solutions or one of it's affiliate
site's servers.
c.) Reseller also agrees to utilize that the
reseller along with any customers are submitted
to the same AUP/TOS Policies while hosted on any
SSSINC Hosting Solutions server or other
facility.
d.) Reseller shall furthermore agree that SSSINC
Hosting Solutions will not be held liable upon
reseller's termination/cancellation for any
reason, this shall include but not be limited to
abuse by the reseller of the AUP/TOS as well as
excessive continued spam, or non-payment of
services.
9. The TOS of SSSINC may be modified at any
time and we will typically email all clients
should this occur please read the AUP and TOS
periodically to view any changes.
